Arkansas ALPR law
§ 12-12-1801 to 1808
Prohibits use of ALPRs by individuals, partnerships, corporations, limited liability companies, associations or the state of Arkansas. Provides exceptions for limited use by law enforcement, by parking enforcement entities, for controlling access to secure areas, by a private landowner, private leaseholder, or commercial business for the purpose of promoting public safety, deterring crime, and monitoring access to private property or the Arkansas Highway Police Division of the Arkansas Department of Transportation for electronic verification of the movements of commercial vehicles on state highways. Captured plate data shall not be preserved for more than 60 days by a private landowner, private leaseholder, or commercial business, or 150 days by all other eligible entities, except data obtained for law enforcement investigations may be retained during the investigation and shall be destroyed at the conclusion of the case. Governmental entities using ALPR systems shall update captured plate data every 24 hours if updates are available. Governmental entities shall not sell, trade, or exchange captured data for any purpose, except law enforcement may share data indicating evidence of an offense with other law enforcement agencies and may compel release of data from certain users only through a valid subpoena. Requires government users to compile statistical data every six months in a format allowing public review. That data must be preserved for 18 months. Government users must promulgate public rules and policies concerning obtaining, retaining, and destroying captured plate data, including retention of material exceeding the 150-day law. Preserved data must include the number of license plates scanned, names of lists against which captured plate data were checked, and for each check the number of confirmed matches, matches not correlating to an alert, and matches resulting in arrest and prosecution. Private landowners, private leaseholders, or commercial businesses using ALPRs must compile statistical data every six months on the number of plates scanned and confirmed matches and make reports available to the Legislative Council upon request from the chairs. More detailed information exists in the Arkansas Administrative Code 12 CAR 24.
