Utah ALPR law
§ 41-6a-2001 to 2006
A governmental entity may not use an ALPR system except as authorized by law for specified uses. Law enforcement agencies may access captured license plate data for active criminal investigations, apprehending individuals with outstanding warrants, locating missing or endangered persons, or locating stolen vehicles, and may access the Utah Criminal Justice Information System to verify vehicle registration, confirm vehicle identification, verify insurance information, or identify stolen vehicles. A law enforcement agency may not use an ALPR unless it has a written policy regarding the use, management, and auditing of the automatic license plate reader system, and a special use permit from the Department of Transportation. The written policy and special use permit must be posted and made publicly available. Provides that captured plate data are a protected record under the Government Records Access and Management Act if the data is maintained by a governmental entity. Provides that captured plate data may only be shared for specified purposes, may only be preserved for nine months unless there is a preservation request, disclosure order, or a warrant, and may only be disclosed in specified circumstances. Governmental entities may not sell captured data for any purpose or share or use for unauthorized purposes. However, they may preserve and disclose aggregate captured plate data for planning and statistical purposes. A law enforcement agency must preserve a record of information as specified in the statute for a period of at least five years. A person who knowingly or intentionally uses, obtains, or discloses captured license plate data in violation of this part is guilty of a class B misdemeanor.
