Idaho ALPR law
§ 49-1432
Allows an agency to use an ALPR and its data for law enforcement purposes and/or traffic flow analysis. If the agency uses an ALPR for law enforcement purposes, they cannot use the device and its data for any purpose other than the investigation of felony or misdemeanor crimes, traffic accidents, or missing/endangered persons’ searches. Prohibits are used for traffic enforcement. Limits access to ALPR data to only authorized personnel. Requires agencies to implement access controls to ensure that only individuals with appropriate clearance can retrieve data. Prohibits non-law enforcement use, including for personal use, political activity or surveillance unrelated to authorized purposes. Misuse subjects the individual to discipline, administrative penalties and criminal prosecution, if applicable. Requires mandatory training for all authorized users related to data privacy, compliance, and ethical use. All access and queries are required to be logged in a secure audit system that includes user identity, date, time, and purpose of access. Requires semiannual audits of data access logs to address any unauthorized activity.
