New Mexico ALPR law
§ 29-22-1 to -5
ALPR users shall not sell, share, allow access to, or transfer data if they have reasonable belief, it may be used for immigration enforcement, investigating or prosecuting protected health care activity, or identifying or imposing liability based solely on participation in activities protected by the United States constitution or the constitution of New Mexico. ALPR users shall not allow access to data by an out-of-state third party or a non-New Mexico law enforcement agency without first obtaining a written declaration that the party affirms the information will not be used in violation of the statute. ALPR users shall not sell, share, allow access to, transfer, or otherwise make available data to non-law enforcement officers or agencies, except to the user's ALPR vendor for providing service. Data is confidential and not considered a public record. Privately captured ALPR data may only be sold, shared, transferred, or released with express consent of the private entity or pursuant to a valid court order. Outlines annual reporting requirements, including number of cameras, list of all databases compared, total number of queries and purpose, list of other law enforcement agencies granted access to data, number unauthorized access instances, number of subpoenas/warrants/third party requests received, number of requests from third-party out of state parties and a list of all out of state agencies that queried data. Establishes penalties for violation of articles. Law enforcement agencies that fail to comply may have that agency’s ALPR data sharing privileges revoked, and access to the state-managed ALPR system restricted. Vendors that fail to comply may be subject to corrective action, suspension of authorization, or termination of access. The attorney general or district attorney is authorized to enforce the provisions of this law. Injunctive relief and civil penalties of up to $10,000 or actual damages can be awarded.
