Public Safety Code § 3-509

Captured plate data can only be used for legitimate law enforcement purposes as defined in the statute including investigating crimes, violations of vehicle laws, terrorist or missing person searches/alerts. Historical license plate data cannot be sold, accessed by vendors without explicit authorization, or uploaded to other agencies/entities outside the state. Law enforcement agencies must adopt procedures for operating ALPR systems and data, including access controls, data protection measures, auditing processes, training and breach of reporting. Data is not subject to disclosure under the Public Information Act. The Department of State Police must submit an annual report with specific details on the use of ALPR systems by law enforcement agencies. An employee of a law enforcement agency or the vendor contracted by the law enforcement agency who violates this subsection is subject to imprisonment not exceeding 1 year or a fine not exceeding $10,000 or both.
