Marshall County, Indiana prosecutor sends cease-and-desist letter as commissioners move to cover Flock cameras

Marshall County Prosecuting Attorney E. Nelson Chipman Jr. sent county commissioners a cease-and-desist letter on Tuesday, Oct. 20, 2026, demanding they stop plans to "bag and tag" six Flock license plate readers that he says are leased to his office, GIANT fm and WVPE reported. The letter calls the plan "tyrannical" and says covering the cameras would disable private property without due process; Chipman wrote that his office could consider options "including self-help" (GIANT fm). At their Oct. 19 meeting, commissioners voted 2-1 to have the Highway Department cover the six county Flock cameras within 14 days and to reject any Flock claim not prorated to Dec. 20-31, 2026, with Commissioner Stan Klotz voting no (GIANT fm). County attorney Sean Surrisi said legal risk was "a little bit" but that he believed the county would ultimately win (WVPE). Klotz later said highway workers will not cover the cameras (GIANT fm). The County Council earlier voted 4-3 to stop funding the contract after Dec. 31, 2026.
